Special committee re:indemnities
Terms of reference
To consider the introduction of an indemnity scheme for members, employees and officers of the Authority, pursuant to the Local Authorities (Indemnities for Members and Officers) Order 2004
- To consider, in accordance with the approved Indemnities Scheme for Members, Employees and Officers of the Authority, and after due consideration of all the merits and circumstances of each case placed before them, whether to apply the indemnity and undertaking in paragraph 1 of the Indemnity Scheme to:
- (a) the defence of any criminal proceeding brought against a member or employee or officer and to any civil liability arising out of any action or failure to act which also constitutes a criminal offence; or
- (b) the defence of proceeding pursuant to Part 3 of the Local Government Act 2000 by a member subject to the reimbursement of any sums expended in the event of (i) conviction of a criminal offence (and that conviction being not overturned following any appeal) or (ii) a finding that a member has failed to comply with the Members’ Code of Conduct (the Code) (and that finding not being overturned following any Appeal), or the member admitting he or she has failed to comply with the Code, in accordance with the approved Indemnities Scheme of Members, Employees and Officers.
Delegation
- The Special Committee has full delegated power to act within its terms of reference, with its minutes being submitted to the Authority.
