Terms of reference

The Standards Committee will have the following roles and functions:

  • To promote and maintain a high standard of conduct by members; to oversee the Registers of Members’ Interests; and to oversee the effectiveness of the Authority’s procedures for investigating and responding to complaints about members.
  • To assist members to observe the Members’ Code of Conduct.
  • To advise the Authority on the adoption or revision of the Members’ Code of Conduct.
  • To monitor the operation of such Code.
  • To advise, train, or arrange to train Members on matters relating to the Members’ Code of Conduct.
  • To grant dispensations to members from requirements relating to interests set out in the Members’ Code of Conduct.
  • To consider and act on any reports from a case tribunal or an interim case tribunal and any report from the Monitoring Officer on any matter which is referred by an Ethical Standards officer to the Monitoring Officer.
  • To convene and conduct a hearing in relation to a report referred to the Monitoring Officer from an Ethnical Standards Officer under section 64(2) or 71(2) of the Local Government Act 2000 which alleges that a member failed to comply with the Members’ Code of Conduct or with the Code of Conduct of any other authority concerned.
  • To consider and as necessary convene and conduct a hearing in relation to any cases referred to the Committee by the Monitoring Officer following local investigation
    pursuant to a reference of a matter by an Ethical Standards Officer to the Monitoring Officer for investigation; or in pursuance of reference to the Committee by the Monitoring Officer of an alleged breach of a local protocol by a Member of the Authority.
  • To conduct any hearings convened under paragraph 2(h) or 2(i) using such procedures as it considers appropriate; to make such findings as it considers appropriate within those which it is entitled to make by law; to impose such sanction as it considers appropriate within those which it is entitled to impose by law; and to give such notices of its findings as are required by law.
Delegation 
  • The Standards Committee has full delegated power to act within its defined role and function and may establish one or more Sub-Committees with full delegated powers to determine any matter which, having been referred to the Committee under paragraphs 2(h) and 2(i) above, is referred by the Committee to the Sub-Committee with its minutes being submitted to the Authority.
